Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Cycleone's websites, mobile applications, APIs and any related services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, please do not use the Services. These Terms are a legally binding contract between you ("you" or "User") and Cycleone Limited ("Cycleone," "we," "us" or "our").

2. Acceptance of Terms and Updates

By using the Services you represent that you are at least 18 years old and have the capacity to enter into a binding contract. We may modify these Terms at any time to reflect changes in our business, the law or the Services. We will post the updated Terms and update the "Last updated" date. Continuing to use the Services after changes become effective constitutes your acceptance of the revised Terms.

3.1 User responsibilities. You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:

You must notify us immediately of any unauthorized use of your account.

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business use. You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any content without our prior written permission.

5. Third-Party Content and Links

The Services may contain links to third-party websites, services or content that are not owned or controlled by Cycleone. For example, we display financial data, news and analytics supplied by external providers. We make no representations and assume no responsibility for the content, privacy policies or practices of any third-party websites or services. You acknowledge and agree that Cycleone shall not be liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any third-party content, goods or services.

6. Disclaimers

6.1 General information only. All information provided through the Services—including market data, charts, research reports, educational materials and analysis—is for informational and educational purposes only. Cycleone does not provide investment, financial, legal or tax advice. You should consult professional advisors before making any investment decisions. Past performance is not indicative of future results.

6.2 No warranties. The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Cycleone and its suppliers disclaim all warranties, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free or that the data is accurate, complete or current.

7. Limitation of Liability

To the maximum extent permitted by law, Cycleone and its affiliates, directors, officers, employees and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or other intangibles, arising out of or relating to your use of or inability to use the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Services will not exceed the greater of CHF 100 or the amount you paid to us (if any) for the Services.

8. Indemnification

You agree to indemnify and hold harmless Cycleone and its affiliates, officers, agents, employees and licensors from and against any claims, damages, obligations, losses, liabilities, costs or debt and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any copyright, property or privacy right; or (d) any claim that your user content caused damage to a third party.

9. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of Switzerland, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction of the courts in the canton of Valais, Switzerland. If you are a consumer and your habitual residence is in a member state of the European Union, you may benefit from any mandatory provisions of the law of the country in which you are resident.

10. Miscellaneous

If any provision of these Terms is found by a competent court to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to do so. These Terms constitute the entire agreement between you and Cycleone regarding the Services and supersede any prior agreements on the same subject matter.
